Terms of Service
Draft for review by a Texas attorney. Operator legal identity and contact email must be completed before launch.
Operator: Easy Towings (individual operator; no company entity identified). Contact: [contact email]. Governing state: Texas; county: Dallas County. Last updated: 2026-10-29. Version: 2026-10-28.
1. Who we are; platform only
These Terms govern use of Easy Towings, operated by Easy Towings, an individual operator, not an identified corporation or LLC. Easy Towings is a free technology platform and venue only. We do not provide towing, repair or other roadside services; dispatch, direct or control providers; act as a motor carrier, freight broker, freight forwarder or employer; or set service prices. Providers are independent third parties, not our agents. Any service contract is solely between the customer and provider. Customers pay providers directly. Easy Towings collects no fees or commissions and does not process, hold, guarantee or refund service payments. The actual conduct of the parties and applicable law control legal classifications.
2. Eligibility and acceptable use
You must be at least 18 and legally able to enter a contract. Give accurate account, contact, vehicle, location and service information, protect your login and tracking link, and use the platform lawfully. Do not post fake requests, commit fraud, impersonate others, harass or discriminate, upload unlawful content, scrape private information, interfere with safety or security, or use the platform for illegal towing. We may restrict or suspend access for safety, suspected abuse, inaccurate information, legal obligations or breach of these Terms. Suspension does not cancel obligations owed to a provider.
3. No endorsement or verification guarantee
Provider licenses, USDOT/MC identifiers, insurance, experience, ratings, completed-job counts and other information are supplied by providers or derived from platform activity. They do not guarantee identity, competence, safety, regulatory approval or insurance coverage and are not independently verified unless we expressly state the specific check and its scope. Listing, registration, acceptance of an agreement and a bid are not endorsements. Before work starts, confirm the provider’s required licenses, insurance, equipment, scope, final price and payment/cancellation terms. Any recommendation is informational, not a guarantee.
Customer responsibility to verify
Before accepting any offer, you are solely responsible for verifying that the provider’s USDOT/MC identifiers and all required state and local towing licenses (including Texas TDLR where applicable) and insurance are valid, active and belong to that provider, and for confirming the final price. Ask for licenses and insurance certificates and verify them with the issuing authority or insurer. USDOT/MC requirements depend on the operation; an exemption does not excuse required towing licenses or insurance. Easy Towings does not verify these credentials and is not responsible for your choice of provider, to the maximum extent permitted by law. Official lookup links are tools, not verification by Easy Towings; a listing alone does not prove insurance coverage. Do not accept until you are satisfied. Your bid-specific acknowledgement is recorded when you accept.
4. Emergencies and availability
This is not an emergency service. If you are in danger or an accident involves injuries, call 911 first and stay in a safe place. Do not use the app while driving. We do not guarantee a response, response time, availability, successful matching, GPS accuracy, uninterrupted service or completion. Estimated arrival times are estimates only. You are responsible for deciding whether it is safe to wait or seek other help.
5. Request information and sharing
By submitting a request, you authorize us to share service and vehicle details and the service location with nearby eligible providers so they can bid. Your name, phone and job photos are shared with the winning provider as needed to perform the service; authorized support may access information for safety and troubleshooting. Photos of vehicles may reveal people or other sensitive details; upload only what you have permission to share. Provider GPS is shared with the customer for an active job. Keep your private tracking link secure: anyone possessing it may access that job. The Privacy Policy explains additional processing.
6. Transactional communications, not marketing
You authorize request-related communications by email, push and calls and, only where offered and separately consented as required by law, texts to the number you provide, including automated communications where lawful. This is not consent to marketing and is not a condition of purchasing provider services. Message frequency depends on your request; message and data rates may apply. Reply STOP to a sender’s texts to opt out, or contact [contact email]; providers must honor opt-outs and obtain any consent required for their own communications. SMS is not currently offered by the platform. You may disable push or change email preferences; essential safety/account notices may still be sent where lawful. Opting out may reduce job updates.
7. Your content
You keep ownership of your content and grant us a nonexclusive, royalty-free license to host, reproduce and share it only to operate, secure and support the platform and as described in the Privacy Policy. You represent that you may share it. Do not upload identity documents, payment card data or unnecessary sensitive information. We may remove unlawful or abusive content.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT PROVIDER SERVICES, ACCURACY OR RELIABILITY. Some jurisdictions do not permit certain exclusions; those exclusions apply only where lawful. Nothing excludes rights or warranties that cannot lawfully be waived.
9. Limits of liability and release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Easy Towings AND THOSE ACTING FOR EASY TOWINGS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION. TOTAL AGGREGATE LIABILITY FOR PLATFORM-RELATED CLAIMS IS LIMITED TO US $100 BECAUSE THE PLATFORM IS FREE. You release Easy Towings from claims arising from independent provider services, including delays, vehicle/property damage and provider conduct, to the extent lawful. These limits and release do not apply to liability that cannot be limited or released, including fraud, willful misconduct, gross negligence or nonwaivable statutory rights where applicable. They do not excuse providers from their obligations. Subject to these legal limits, this release also covers claims arising from your choice of provider and your responsibility to verify credentials before acceptance, as described in Customer responsibility to verify.
10. Indemnification
To the extent permitted by law, you will indemnify and defend Easy Towings and persons acting for Easy Towings against third-party claims, reasonable defense costs and damages caused by your unlawful conduct, material breach or infringement of others’ rights. This does not require you to indemnify anyone for their own unlawful conduct or liability that cannot be shifted by law. We will give reasonable notice and cooperation; no settlement may impose obligations or admit fault for us without our written consent.
11. Dispute resolution — arbitration and opt-out
For disputes with Easy Towings (not your separate provider contract), first send a written description, requested relief and contact details to [contact email]. Both sides will try in good faith to resolve the dispute for 30 days after receipt; applicable filing deadlines are tolled during that period where lawful. Either side may use an eligible small-claims court instead. Otherwise disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA), under its Consumer Arbitration Rules for consumer disputes and applicable Commercial Arbitration Rules for nonconsumer business disputes, subject to mandatory law and AAA due-process standards. Rules: https://www.adr.org/rules-forms-and-fees/consumer/; AAA: 1-800-778-7879. The Federal Arbitration Act governs arbitration. An independent arbitrator may award all individual remedies available by law; courts decide enforceability and scope. Hearings may be remote or at a reasonably convenient location, not necessarily Dallas. We pay fees allocated to us by AAA and law and additional fees needed to make consumer access affordable. YOU AND WE WAIVE A JURY TRIAL AND CLASS OR REPRESENTATIVE PROCEEDINGS IN ARBITRATION, to the extent lawful; this does not waive nonwaivable public relief. You may opt out by emailing [contact email] within 30 days of first accepting, with your name, account email or request reference and a clear opt-out statement; no penalty applies. If AAA declines administration and no lawful mutually agreed substitute is available, either side may proceed in court. If the class waiver is unenforceable for a claim, that claim proceeds in court, not class arbitration. Courts may grant provisional relief when allowed. Claims outside arbitration may be brought in a court with jurisdiction in Dallas County, Texas, unless mandatory law requires another venue.
12. Governing law, changes and contact
Texas law applies, excluding conflict-of-law rules, subject to applicable federal law and nonwaivable protections where you live. We publish updated versions and dates; material changes receive reasonable notice and renewed assent when required. Changes apply prospectively, not retroactively to existing disputes without consent. If a provision is invalid, the rest remains effective, subject to the arbitration exceptions above. These Terms, the Privacy Policy and any applicable Provider Agreement are the entire platform agreement; your service contract remains separate. If translations differ, English controls only to the extent lawful and without removing rights based on the Spanish disclosure. Contact: [contact email].
